Real estate law is an area of law that is often ignored, but very necessary.  The transfer of property is often overlooked when a loved one dies. Years may go by before someone wants to sell the property, only to find that the title is not in order and still belongs to a long deceased relative. This is when probate law comes into play. 

The courts will decide who the rightful heirs are and assign a responsible person, usually a family member, to act to transfer the property to the rightful heirs. The process can be costly if investigations have to be conducted to find family members who have lost touch with each other.

This could be avoided with an Estate plan that includes a Will that was probated upon the death of the loved one who owned the property.
